The Gujarat High Court has asked Satellite Police to conduct an inquiry into an alleged incident of land grabbing by a prominent builder at P&T Colony near Jodhpur Crossroads, and file an FIR if needed. The builder allegedly grabbed 500 sq m land owned in the government property where officers of BSNL reside.
BSNL employees had approached court after cops refused to file an FIR against the builder. Assistant General Manager (BSNL) Natvar Limbachiya said, "On March 2, some men arrived in our colony and demolished our compound wall.
They also cut down trees and seized possession of 500 sq m land. The police refused to register a complaint so we approached the HC. "The high court asked police to register a First Information Report (FIR) against Ganesh Housing before 10 am on Saturday but the police only took our application. The builder carried out the demolition claiming they had right over the land." BSNL's lawyer Rashmin Jani submitted before court, "BSNL owns the property and has been paying its tax since two decades. We have documents showing the company's posses-sion of land.
Yet, on March 2, some persons reached the spot along with JCB machines, other vehicles and labour force. They have not only demolished the compound wall, but also started damaging other properties belong to the company." After hearing the case, Justice Sonia Gokani ordered, "Satellite police shall look into the matter and register an FIR as per application moved on March 2 without further loss of time, but not later than Saturday by 10 am, if cognizable offence is made out. It should inquire to find out if cognizable offence is revealed."
The court also said that the police should consider the request of providing protection to the petitioner officer, his family and other residents of P&T Residential Colony situated near Jodhpur Crossroads. According to the court order, the report regarding the incident should be made to the Commissioner of Police. Meanwhile, Inspector (Satellite) M U Mashi told Mirror, "According to primary information, the land belongs to the builder as per a TP scheme drawn a decade ago. They got necessary permission from AMC. We are still looking into the complaint." Managing Director (Ganesh Housing) Shekhar Patel said, "The land belongs to Mahalaxmi Co-operative Housing Society as per the final TP scheme announced a while ago. We have a contract to develop the land. The AMC had also issued notice to BSNL four times, asking them to vacate land. Finally, we took possession of the land using due process."
